What Sunup is
Sunup ("we") is a daily check-in service. You choose a time window each day to tell Sunup you're okay. If you don't, Sunup reminds you and then contacts the people you chose (your "circle") by app notification, text message and phone call. These terms are an agreement between you and Cacti Pacti.
Sunup is not an emergency service
Sunup does not dispatch police, fire or medical help, and it does not monitor you continuously. If you or someone else is in danger, call 911 or your local emergency number.
Sunup depends on things we don't control: your phone's battery, signal, settings and notification permissions; mobile carriers; and the services we use to send texts, calls and notifications. Messages can be delayed or fail. We can't guarantee that any reminder, alert, text or call will be delivered, or that anyone in your circle will respond.
Your account
- You must be at least 13 years old to use Sunup.
- Keep your phone number current. If you sign in with your number, anyone who controls that number can sign in to your account.
- Keep notifications turned on, and keep your check-in window and away-mode settings accurate. Sunup acts on the schedule you set.
Your circle
- Only add people who know you and agree to be contacted about you. When you add someone by phone, Sunup texts them to confirm, and they can reply STOP at any time to stop all texts and calls from Sunup.
- People who watch over you can see your check-ins, mood notes and photos. Information in your "If I go dark" packet is only shown to the people you mark, and only while an alert has reached the release step.
- Don't use Sunup to harass, track or monitor anyone without their knowledge.
Premium subscriptions
- Premium costs $9.99 per month or $79.99 per year, plus any applicable tax, unless a different price is shown when you subscribe. In the iPhone and Android apps, the price is the one the App Store or Google Play shows you, in your currency.
- New subscribers may get a 7-day free trial. Unless you cancel before the trial ends, your subscription starts and you're charged at the end of the trial.
- Subscriptions renew automatically at the end of each period until you cancel. You can cancel any time from Manage subscription in the app; you keep Premium until the end of the period you've paid for.
- Bought in the iPhone app: payment is charged to your Apple ID when you confirm the purchase. It renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your account is charged for the renewal within 24 hours before that. Manage or cancel it in your App Store account settings. Refunds are handled by Apple (reportaproblem.apple.com). Apple's standard licensed application end user license agreement also applies.
- Bought in the Android app: payment is charged to your Google Play account. Manage or cancel it in Google Play under Payments & subscriptions. Refunds are handled under Google Play's refund policy.
- Deleting your Sunup account doesn't cancel a subscription bought in the app: cancel it in your App Store or Google Play settings.
- Bought on the website: payments are processed by Stripe. If you were charged by mistake, email us within 30 days and we'll refund it. Otherwise payments aren't refundable, except where the law requires.
- The daily check-in, the basic alert to your circle, and SOS stay free.
Text messages
Sunup texts your number to sign you in and with alerts about people you watch over. People you add to your circle get one text asking them to confirm, and then only safety alerts about you if they replied YES. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to stop texts and calls at any time. Carriers aren't liable for delayed or undelivered messages.
Sunny, the AI assistant
Sunny uses AI to answer questions and to make changes to your account when you ask, like checking you in or starting a timer. It can misunderstand or get things wrong, so check what it did. It isn't a substitute for medical, legal or emergency help: in an emergency, call 911. Sunny only acts on your own account, and asks you to confirm before anyone is added to your circle.
Acceptable use
Don't misuse Sunup: no false alerts meant to frighten someone, no adding phone numbers you don't have permission to add, no attempts to break, overload or reverse-engineer the service, and no use that breaks the law.
Ending your use
You can stop using Sunup at any time and ask us to delete your account. We may suspend accounts that break these terms, especially where people are being contacted without their consent.
Limits on our liability
Sunup is provided "as is". To the fullest extent the law allows, Cacti Pacti isn't liable for injury, loss or damage resulting from a reminder, alert, text or call that was late, wasn't delivered, or wasn't acted on, or from your circle's actions or inaction. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim.
Changes
We'll tell you in the app before material changes to these terms take effect.
